TRUSTEE'S SALE OF 7683 LEE HWY, RURAL RETREAT, VA 24368 In execution of a certain Deed of Trust dated March 6, 2014, in the original principal amount of $88,163.00 recorded in the Clerk's Office, Circuit Court for Smyth County, Virginia, in Book 862 at Page 00052 as Instrument No. 140000460 . The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Smyth County, 109 West Main Street, Marion, Virginia on May 10, 2021, at 10:00 AM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows: THAT CERTAIN TRACT OR PARCEL OF LAND LYING AND BEING IN THE ATKINS DISTRICT, SMYTH COUNTY, VIRGINIA AND DESCRIBED AS FOLLOWS: "BEING LOT 11 AS SHOWN ON PLAT 2 OF THE MOUNTAIN EMPIRE SUBDIVISION, SAID PLAT BEING RECORDED IN THE CLERK`S OFFICE OF SMYTH COUNTY, VIRGINIA, IN PLAT BOOK 8, PAGE 122." REFERENCE TO WHICH IS HEREBY MADE FOR A MORE PARTICULAR DESCRIPTION OF SAID LOT OR PARCEL OF LAND HEREIN CONVEYED. THIS CONVEYANCE IS MADE SUBJECT TO THE RESERVATIONS, RESTRICTIONS, CONDITIONS, EASEMENTS AND RIGHT OF WAYS OF RECORD IN THIS CHAIN OF TITLE. TERMS OF SALE: ALL CASH. A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser's deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid.
