NOTICE OF SUBSTITUTE TRUSTEE'S SALE WHEREAS, by Deed of Trust dated September 30, 2013, of record in the Clerk's Office of the Circuit Court of Washington County, Virginia, as Instrument No. 130005785, David Lee Pratt, II and Charlann M. Pratt conveyed the real estate hereinafter described to B & H Lending Services, LLC as Trustee, for the benefit of Russell E. Altizer and Lynna H. Altizer, to secure the payment of the debt therein fully and definitely described; and WHEREAS, by Deed of Appointment and Designation dated June 1, 2021, of record in said Washington County, Virginia, Clerk's Office as Instrument 210003540, David J. Hutton and/or Daniel S. Robinson were substituted as Trustees herein; and WHEREAS, default has been made in the payment of the debt secured by the Deed of Trust and the undersigned Substitute Trustee has been requested by the holder of the Note to foreclose the lien of said Deed of Trust by sale of the hereinafter described property; and NOW, THEREFORE, NOTICE is hereby given that on Friday, July 30, 2021, at 10:30 a.m., the undersigned will offer for sale at public auction by special warranty deed to the highest bidder for cash on the property to be sold, located at 23090 Montego Bay Road, Abingdon, VA 24211 the following tract or parcel of land: All that certain lot or parcel of real estate, together with all improvements thereon and appurtenances thereunto belonging, situate and being in the Madison Magisterial District of Washington County, Virginia, known and designated as Lot No. 26 and Lot No. 27 of the Wyldwood Subdivision, a plat of which is entitled in part, "REPLAT OF PLAT 1 OF WYLDWOOD SUBDIVISION ON SOUTH HOLSTON LAKE," prepared by Thompson & Litton, Consulting Engineers and of record in the Office of the Clerk of the Circuit Court of Washington County, Virginia in Plat Book 13, Pages 96-98, inclusive, reference to which is hereby made for a more particular description of the real property hereby conveyed. This conveyance is made subject to the terms, conditions and provisions of that certain Declaration of Covenants, Conditions and Restrictions for Wyldwood subdivision dated June 29, 1970, and of record in the Office of the Clerk of the Circuit Court of Washington County, Virginia in Deed Book 459, Page 210. AND BEING the same real property conveyed to the Grantors herein by Deed dated October 1, 2013 of record as Instrument No. 130005784, reference to which is hereby made for a more particular description of the source of the real property hereby conveyed. Tax Map No. 1676B-l-26 & 167B-1-27 The sale is subject to and the beneficiary of the conditions, covenants, restrictions, reservations, party wall rights, easements, right of way and other matters of record applicable to the property, and real estate taxes from the date of the sale. PROPERTY ADDRESS: 23090 Montego Bay Road, Abingdon, VA 24211 TERMS OF SALE: 10 percent down in cash, cashier's check, certified check or postal money order with balance in cash at closing within 30 days. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the Trustee's compensation authorized by the Deed of Trust and the law in such cases. All costs of conveyance, which shall be by special warranty deed, examination of title, recording taxes, notary fees, settlement fees and grantor's tax, to be at the cost of the purchaser. The Trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement.
