Notice of Trustee's Sale of Property Located at Harris Lane and Spring Valley Road, Marion, Virginia on Saturday, September 26, 2020 at 10:00 am Pursuant to the terms of a Deed of Trust dated September 8, 2010, and of record in the Clerk's Office of the Circuit Court of Smyth County, Virginia, in Deed Book 802, Page 1, and default having been made in the payment of the debt secured by said Deed of Trust, and at the direction of The Bank of Marion, Virginia, Beneficiary, that the property be sold, the undersigned Trustee will offer for sale at public auction to be held at 1015 Spring Valley Road, Marion, Virginia, on Saturday, September 26, 2020, at 10:00 a.m., the following described property: All those certain tracts of land, with all improvements and appurtenances thereon, lying and being in the Park District, Smyth County, Virginia, and described as follows: Tract No. 1. Designated as 56.41 acres, more or less, as shown on a plat of survey by Joe T. Gollehon, C.L.S., entitled, "Plat Showing Property of Dr. Robert V. Galliott (sic) et ux, located North of Marion, Smyth County, VA.", of record in Plat Book 8, Page 89, which is incorporated herein and made a part hereof, and to which reference is made for a more particular description of the property herein conveyed. Tract No. 2. Containing 89 acres, more or less, lying on the Old Chilhowie Road, and described by survey as follows: "Beginning at a large chestnut on a hill, corner to Odham and Charles Hart, and with the latter N 14 00 E 2265 feet to a post; thence with Allen's line S 53 30 E 1240 feet to a post about 100 feet west of the road; N 53 30 E 1830 feet crossing the road, with Allen and the Oaks land, to a post in line of E. T. C. Oaks; and with same S 55 15 E 358 feet to a set stone, a corner to Harry T. Totten, and same for division line S 27 45 W 2120 feet to a stake in the public road, in line of Jim Odham, and with same N 66 10 W 595 feet to a stake west of the road; thence S 76 25 W 427.5 feet to a set stone; S 45 45 W 808 feet to a post and walnut; S 85 42 W 803 feet to the beginning." Included with Tract No. 2 is the right to water from the well reserved in Deed Book 210, Page 224. Less and except from Tract No. 2 is that 1.31 acre tract conveyed in Deed Book 398, Page 486. Tract No. 2 is subject to that 20' road right of way in Deed Book 398, Page 486. Tract No. 4. Parcel No. 1. Designated as 76.60 acres, more or less, as shown on plat of record in the Clerk's Office of Smyth County, Virginia, in Plat Book 1, Page 57, to which reference is made. Parcel No. 2. Designated as 34.90 acres, more or less, as shown on plat of record in the Clerk's Office of Smyth County, Virginia, in Plat Book 1, Page 57, to which reference is made. Parcel No. 3. "Beginning on a post located in the northern line of said State road on corner of the L. R. Wolfe Tract of land; thence northwardly 73 feet with line of Wolfe land to a corner of same; thence eastwardly 236 feet with the Wolfe line, to a rock on corner of the Wolfe land and the Walker Tract; thence Southwardly 92 feet for a new division line, to a point in the northern line of the said State Road; thence westwardly 211 feet with the northern line of said State Road, to the beginning and being the same property conveyed to Eleanor Walker by Clarence W. Walker et ux by deed dated October 23, 1949, and recorded in Deed Book 108, Page 530. Less and except from Tract No. 4 are those tract conveyed in Deed Book Deed Book 61, Page 238, Deed Book 200, Page 288, Deed Book 217, Page 32; Deed Book 347, Page 204; and in Deed Book 480, Page 210.
