NOTICE OF SUBSTITUTE TRUSTEES' SALE 305 BELLEMEADE CIRCLE, BRISTOL, VA 24201 Pursuant to the terms of a Deed of Trust dated December 17, 2012, of record in the Circuit Court Clerk's Office for the City of Bristol, Virginia in Book 578, Page 56, Douglas R. Hayden and Yvonne C. Hayden, husband and wife, conveyed to Thomson Lipscomb, Trustee, the hereinafter described real estate to secure the payment of a note in the original principal amount of $84,000.00. Michael Page and Kristie Helms were appointed Substitute Trustees by Substitution of Trustee dated April 14, 2021, of record in the Circuit Court Clerk's Office for the City of Bristol, Virginia, in Book 675, Page 729. Default having been made in the payment of said indebtedness and other provisions of the Deed of Trust having been violated, and Eastman Credit Union, the holder of said indebtedness has declared the entire amount due and payable as provided in said Deed of Trust, and the Substitute Trustees have been directed to foreclose the Deed of Trust in accordance with the terms thereof. The public is hereby notified that the undersigned Substitute Trustees will sell the hereinafter described real estate at public auction to the highest and best bidder, for cash in hand, on Friday, May 7, 2021, at 10:00 a.m. at the main entrance to the Bristol, Virginia Courthouse, 497 Cumberland Street, Bristol, Virginia 24201: Situate in the City of Bristol, Virginia, and more particularly described as follows: BEING Lot No. 48 as shown on plat designated "Belle Meadows", prepared by A.E. Bost, Engineer, dated June 29, 1958, scale 1"=60', recorded in Plat Book 1A, Page 108 in the Circuit Court Clerk's Office for the City of Bristol, Virginia, reference being here made to said plat for a more complete description; and being the same property conveyed to Douglas R. Hayden and Yvonne C. Hayden, husband and wife, by Deed dated December 17, 2012, of record in the Circuit Court Clerk's Office for the City of Bristol, Virginia in Book 578, Page 52. Tax Map # 13(7)48; Property Address: 305 Bellemeade Circle, Bristol, VA Terms: The purchase price in the form of immediately available funds shall be due and payable on the closing date. A deposit in the form of immediately available funds in the amount of ten percent of the successful bid may be required of any bidder at the time of sale. The successful bidder shall pay the balance of the purchase price by cash or certified funds within seven (7) days and not to exceed thirty (30) days following the foreclosure sale date or such date as determined by the Trustees. Time will be of the essence as to the closing date and the payment of the purchase price. The property will be sold "AS IS". The real estate will be conveyed by Special Warranty deed, subject to all rights, reservations, leases, covenants, conditions, easements and restrictions superior to the deed of trust as they may lawfully affect the real estate. Neither the Trustees nor the holder of the note secured by the deed of trust will deliver possession of the property to the successful bidder. The purchaser at the sale will be required to pay all closing costs except the grantor's recording tax. If a party other than the holder of the note is the successful bidder, real estate taxes will be assumed by the successful bidder and shall be paid at closing.
